Terms of Use Agreement

This website is operated by TerraTribe. Throughout these Website Terms and Conditions (“Terms”), the expressions “we”, “us” and “our” refer to TerraTribe.

Access to and use of this Website and the products and services available through this Website (collectively, the "Services") are subject to the following terms, conditions, and notices (the "Terms of Service"). By using the Services, you are agreeing to all of the Terms of Service. We reserve the right to revise, modify or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for amendments. Your continued use of or access to the website following the posting of any amendments constitutes acceptance of those amendments.


Section 1: The Sale of Products

You can purchase products either online through our website or in person at our store located at Eatons Hill. Please see our Contact us page for further details.


Section 2: Terms of Sale

By placing an order through this website, you are committing to purchase product(s) on and subject to the following terms and conditions. Note: All orders are subject to availability and confirmation of the order price.

Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or force majeure for which we will not be responsible. Please see our Shipping policy page for further information.

In order purchase from us you must possess a valid credit or debit card issued by a bank acceptable to us. TerraTribe retains the right to refuse any request made by you, and TerraTribe reserves the right to close your TerraTribe account at its sole discretion. If your order is accepted, we will inform you by email and we will confirm the identity of the party which you have contracted with. This will usually be TerraTribe or may in some cases be a third party.

When placing an order, you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. The cost of foreign products and services may fluctuate. All prices advertised are subject to such changes. Please be aware that some of the goods sold through our website may not be suitable for children under 18 years of age, so please take extra care when purchasing goods as gifts, for under 18’s.

 A. Our Contract

    When you place an order, you will receive an acknowledgement e-mail from us confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until your payment has been approved by us and we have debited your credit or debit card.

     B. Delivery of Products

    The delivery times provided by TerraTribe are only estimates. TerraTribe will not be liable for loss or damage caused by late deliveries beyond its control. If multiple items are ordered, part deliveries may be made where stock is not available. All reasonable attempts to notify you will be made using the details you provided.

     C. Change of Address

    The shipping address for your order is shown at checkout, in your order confirmation email and shipping confirmation email. In the case that an incorrect address has been entered, changes to that address can only made up until the order starts being processed. TerraTribe cannot accommodate address change requests after this time.

     D. Pricing and Availability

    Whilst we try and ensure that all details, descriptions, and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

    Shipping costs will be charged in addition; such additional charges are clearly displayed on the final page where applicable and included in the 'Total Cost'. Where applicable, prices are inclusive of GST.

     E. Price Matching

    We currently only price match in store and not online. In store, we will try our best to match the prices of items that you can purchase from other Australian retailers. If you would like us to match a price please give us a call, send us a message, or drop into store.

    Terms and conditions for price matching:

    • The exact item must be in stock (same Model/Colour/Size).
    • Price must be in Australian dollars and includes any shipping costs.
    • Price must be visible on competitor's website. We do not price match coupon codes, membership discounts, or other special discounts.
    • We reserve the right to not match prices from products sold through third party marketplaces (e.g., eBay, Amazon, etc).

    The warranties and guarantees given on the product must also be the same as we are offering - we can't match grey imports.

     F. Payment

    We check all orders to ensure sufficient funds are available and to confirm the validity and security of the payment method. All credit card payments are subject to fraud. TerraTribe reserves the right to decline or refund an order that we suspect to be unauthorised or from an untrusted source.


    Section 3: Privacy Policy

    Our Privacy Policy sets out how we will use your information and can be found on our Privacy Policy page. By using our website, you consent to our privacy policy, and you guarantee that all the data that you provide is accurate and up to date. You are responsible for maintaining and updating account information for accuracy and completeness in a timely manner.

    Your submission of personal information in the store is also governed by our Privacy Policy.


    Section 4: Disclaimer of Liability

    TerraTribe is not liable for any losses or damages arising from any external website linked to or from this website that TerraTribe does not control. We reserve the right to refuse any order without giving reason. Upon cancellation of an order, we will make all reasonable effort to contact you directly, using the details provided. If an order is cancelled, all received monies will be refunded using the original payment method.


    Section 5: Copyright and Trademark

    Except where expressly stated to the contrary all persons (including their names and images), third party trademarks and images of third-party products, services and/or locations featured on this Website are in no way associated, linked, or affiliated with TerraTribe and you should not rely on the existence of such a connection or affiliation. Any trademarks/names featured on this Website are owned by the respective trademark owners. Where a trademark or brand name is referred to it is used solely to describe or identify the products and services and is in no way an assertion that such products or services are endorsed by or connected to TerraTribe.


    Section 6: Linking to Third Party Websites

    This Website also contains links to other third-party websites, which are not operated by TerraTribe. TerraTribe has no control over these third-party websites and accepts no responsibility for them or for any loss or damage that may arise from your use of them. Your use of these third-party sites will be subject to the terms of use and service contained within each site.


    Section 7: Returns and refunds

    All returns must be in the same original condition that you received it, unworn or unused, with original tags on, and in its original packaging and within the returns policy timeframe, unless faulty. You will also need the receipt or proof of purchase.

    Faulty goods will be dealt with as per the manufacturer's warranty and terms (See Section 8 below).

    To return an item, please start by contacting us at info@terratribe.com.au. We will reply to you to advise you of the next steps.

    Return shipping costs due to change of mind or incorrect sizing are the customer's responsibility. Return shipping costs will only be refunded when the return is due to our error. We recommend sending returns via registered post or courier, as we will not be held liable for lost items.

    Returns must be made within the timeframe listed on the Returns Policy page, unless faulty. Any items returned outside of this period (unless faulty) or items that are returned damaged or soiled (unless faulty) will be the responsibility of the customer to retrieve. TerraTribe will not pay to return these items to you, and you will not be given a refund.

    Note: Due to health regulations, we are unable to exchange or refund on any underwear purchase, unless faulty and within the manufacturer's warranty period.


    Section 8: Warranties and Repairs

    Repairs are usually carried out by the manufacturer themselves and not by TerraTribe. In the rare cases that the faulty items cannot be repaired, a replacement product or store credit will be offered instead.
    TerraTribe has no control over manufacturer warranty periods or repair periods and cannot advise how long they will be. We will, however, do all that we can to ensure that your warranty claim is processed as quickly as possible and that you are kept informed throughout the process. In cases where you have returned goods directly to the manufacturer, TerraTribe cannot be held accountable for repair periods or communication from the manufacturer.

    We do not refund postage or cover the cost of return postage on warranty claims, as your warranty is a manufacturer warranty and not a TerraTribe warranty. If you have received a product that is damaged or incorrect, then postage will be refunded.

    Section 9: Accuracy, Completeness and Timeliness of Information

    This website may contain typographical errors or other errors or inaccuracies and may not be complete or up to date. We therefore reserve the right at any point to correct any errors, inaccuracies, or omissions and to alter or revise information at any time without prior notice. We reserve the right to refuse to fill any orders that you may place based on information on the Service that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies.


    Section 10: Variations

    TerraTribe has the right in its absolute discretion at any time and without notice to amend, remove, or vary the Terms of Services and/or any page of this Website.


    Section 11: Indemnity

    You agree to indemnify, defend and hold harmless TerraTribe, its directors, officers, employees, consultants, agents, and affiliates, from any and all third-party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use this Website or your breach of the Terms of Service.


    Section 12: Access to Website

    Access to this Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason this Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all of this Website.


    Section 13: Governing Law

    These Terms and Conditions are governed by the laws of Queensland. The parties submit to the non-exclusive jurisdiction of courts exercising jurisdiction there.


    Section 14: Entire Agreement

    These Terms and Conditions constitute the entire agreement of the parties with respect to the items to which it relates and supersedes any and all prior conduct (including any agreements in relation thereto) by the parties with respect to those items. Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

    Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by a Director of TerraTribe.
